These Terms of Service govern your use of BlueWave Adventures services and website. By booking our outdoor adventure services, you agree to these terms and conditions. Please read them carefully before participating in any of our activities.

1. Service Agreement
BlueWave Adventures provides guided outdoor recreation services including surfing lessons, kayaking tours, and coastal hiking trips in Byron Bay, New South Wales, Australia. By participating in any of our activities, you enter into a binding agreement with BlueWave Adventures and acknowledge that you have read, understood, and agree to comply with all terms outlined in this document.
Our services are provided by certified guides and instructors who maintain current safety certifications and local knowledge. All equipment used in our activities meets Australian safety standards and is regularly inspected and maintained according to manufacturer specifications and industry best practices.
2. Booking and Payment Terms
All bookings require advance payment and confirmation. Prices are quoted in Australian Dollars (AUD) and include GST where applicable. Payment can be made through our secure online booking system or by contacting our office directly. Full payment is required at the time of booking unless otherwise arranged.
Group bookings and corporate packages may be eligible for special pricing and payment terms. Custom adventure packages require a deposit of 50% at booking with the balance due 48 hours before the scheduled activity. All payments are processed securely through encrypted payment gateways to protect your financial information.
3. Cancellation and Refund Policy
Cancellations made more than 48 hours before the scheduled activity are eligible for a full refund minus a 5% processing fee. Cancellations made within 48 hours of the activity forfeit 50% of the total payment. No refunds are provided for no-shows or cancellations made less than 24 hours before the activity.
Weather-related cancellations initiated by BlueWave Adventures due to unsafe conditions are eligible for full refund or rescheduling at no additional cost. We reserve the right to cancel or modify activities due to weather, ocean conditions, or other safety concerns. In such cases, alternative dates will be offered or full refunds provided.
4. Participant Requirements and Restrictions
All participants must meet minimum age requirements and physical fitness levels appropriate for their chosen activity. Surfing lessons require participants to be comfortable in water and able to swim at least 50 meters unaided. Kayaking tours require basic swimming ability and reasonable upper body strength. Hiking activities are graded by difficulty level.
Participants must disclose any medical conditions, injuries, or medications that might affect their ability to safely participate in activities. Pregnant women, individuals with heart conditions, back injuries, or other serious medical conditions should consult their physician before booking. We reserve the right to refuse service to anyone whose participation might endanger themselves or others.
5. Safety Requirements and Liability
All participants must attend mandatory safety briefings before activities commence. Failure to follow safety instructions or guide directions may result in immediate removal from the activity without refund. Participants are required to wear all provided safety equipment including but not limited to life jackets, helmets, and appropriate footwear as directed by guides.
While BlueWave Adventures maintains comprehensive insurance coverage and follows strict safety protocols, outdoor activities involve inherent risks. Participants acknowledge these risks and participate at their own discretion. All participants or legal guardians must sign liability waivers before participating in any activities.
6. Equipment and Personal Property
BlueWave Adventures provides all necessary safety and activity equipment including surfboards, wetsuits, kayaks, paddles, life jackets, and safety gear. Participants are responsible for the care of provided equipment during activities and may be charged for damage beyond normal wear and tear.
Personal belongings brought on activities are at the participant's own risk. We recommend leaving valuables secured at your accommodation or vehicle. BlueWave Adventures provides waterproof storage for small personal items during water-based activities but cannot guarantee complete protection from water damage.
7. Photography and Media Usage
BlueWave Adventures may photograph or video record activities for promotional, educational, and safety purposes. By participating in our activities, you grant BlueWave Adventures permission to use your likeness in photographs, videos, and other media for marketing and promotional purposes without additional compensation.
If you prefer not to be included in promotional materials, please inform your guide at the beginning of the activity. We respect participant privacy and will make reasonable efforts to accommodate such requests while maintaining our ability to document activities for safety and training purposes.
8. Environmental Responsibility
All participants must follow Leave No Trace principles and respect the natural environment. This includes not disturbing wildlife, staying on designated trails during hiking activities, and properly disposing of all waste. Marine life encounters during kayaking should be observed from a respectful distance.
BlueWave Adventures is committed to sustainable tourism practices and environmental conservation. We ask all participants to support these efforts by following environmental guidelines provided by guides and helping to preserve Byron Bay's natural beauty for future generations of adventurers.
9. Dispute Resolution
Any disputes arising from these terms or your participation in BlueWave Adventures activities will be resolved through binding arbitration under Australian law. The arbitration will take place in Byron Bay, New South Wales, and will be conducted in English according to Australian arbitration procedures.
Before initiating formal dispute resolution, we encourage participants to contact our management team to discuss any concerns or issues. Many problems can be resolved through direct communication and our commitment to customer satisfaction and safety.
10. Terms Modification
BlueWave Adventures reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the revision date clearly indicated. Continued use of our services after term modifications constitutes acceptance of the updated terms and conditions.
Significant changes to terms that materially affect participant rights or obligations will be communicated via email to registered customers when possible. We recommend reviewing these terms periodically to stay informed of any updates or modifications to our service policies.
